Terms of Service
Section 1 - Community Code of Conduct
The following will not be tolerated:
- illegal or unauthorised activity
- harassing and/or attacking Poniverse users - including Poniverse staff - via verbal, physical, written, or other abuse
- spamming of or on any Poniverse services
The following is is not allowed anywhere on the Poniverse network except where explicitly permitted and directed (such as marking an uploaded Pony.fm track as "explicit"):
- overtly sexual content
- overtly violent or grotesque content
The following is allowed in tasteful moderation:
- implied sexual content
- swearing or obscene language
You must be 13 years of age or older to hold a Poniverse account.
You must get written permission from Poniverse to create/hold multiple Poniverse accounts. Note that you can change your public display name on Poniverse's services without creating a new account.
A Poniverse account may only be used by the person who created it.
Users are responsible for all activities that occur under their accounts.
Users are responsible for maintaining the security of their account and password.
All content is subject to moderation by Poniverse staff but this is not a promise that all content will be moderated.
When you post, link, or otherwise make content available on Poniverse services, you grant Poniverse a perpetual, worldwide, non-exclusive, royalty-free, irrevocable, sublicensable, and transferable license to use, reproduce, modify, prepare derivative works of, perform, publicly display, and distribute your content. This license will survive a termination of this agreement.
Section 2 - Punitive Actions
Punitive actions may differ among Poniverse services. Please check with the individual services for punitive policies specific to them.
Bans from one service do not automatically propagate to Poniverse's other services. However, a user's history from one Poniverse service may be used to make a moderative decision on another.
Poniverse reserves the right to remove any user-posted content from its services at any time, for any reason, with or without notice to its author.
Poniverse reserves the right to suspend a user's access to any or all of Poniverse's services at any time, for any reason, and for any length of time, with or without notice to the user.
Section 3 - Moderation Appeals & Disputes
Because we recognize that no one is perfect, including our own staff, we provide channels for users to appeal or dispute moderative actions taken against them.
Moderation appeals are handled on a best-effort basis. Opening an appeal provides no guarantee whatsoever that actions taken against you will be reversed. Poniverse staff always have the final say.
All appeals, with the exception of PoniArcade appeals, are handled privately.
Failure to maintain the confidentiality of your appeal, when the designated channel for such is not a public one, may invalidate your appeal and lead to further punitive action, as deemed appropriate solely by Poniverse.
Section 4 - Terms of Service Updates
Poniverse may update these terms at any time, at its sole discretion.
Any changes to these terms will become effective 7 days after their implementation.
Your continued use of the Poniverse websites and services constitutes an agreement to the current terms of service.
Section 5 - Legal fine print
This agreement, and any claims or disputes that arise between you and Poniverse, shall be governed under the laws of British Columbia, Canada, without regard to conflict-of-laws provisions.
Should any part of this agreement be found unenforcable, the rest of it will remain valid and in force to the fullest possible extent.
